Terms for Bidding Procedure

To send in your bid for any of the costumes:

SMS BID <Product Code> <Your Bid Amount> to 57575

To know the Current highest bid: SMS TOPBID to 57575

• At any given point, to know the details for the current costume up for bidding tune in to Zee Cinema Channel. The information is also displayed on this website.

• All the costumes up for bidding are originally worn by Actors in the films stated.

• For a bid to be valid, every bid sent should be higher than the base price for the costume

• Every fresh bid should be higher than the previous higher bidder’s bid.

• The costumes will be up for bidding only in the time mentioned alongside each costume.

• Bids submitted after expiry of bidding time shall be invalid and shall not be considered.

• During the process of bidding, as and when any bidder exceeds your bid, which was intimated as the highest then, intimation shall be given to you through SMS.

• Each SMS shall be charged at the following rates

Airtel/ Idea:/ LOOP/ Reliance/ Aircel/Tata GSM Rs.10, BSNL Rs.11, MTNL Rs 2 /
Rs.1, SHYAM Rs.3

• Each Bid shall be made in multiples of Rs. 500. Bids not made in multiples of Rs. 500 shall be rejected. For example, if the current bid for your choice number is Rs 5500/-, then you can bid any amount above Rs 5500/- in multiple of 500 i.e. Rs 6000/-, Rs 6500/-,Rs.7000/- etc

• In each Bid, a bidder can increase previous bid maximum by Rs.3000/-

• At the end of bidding process, Top three (Eg. H1, H2, H3) shall be informed by the Company about his/her status and shall be required to provide Name, Address and other details. These details shall be used to contact the selected bidder. If the highest bidder fails to deposit the bid amount with the Company within the allotted time mentioned in the intimation letter, the item shall be offered to second highest bidder without any reference or further intimation to the fist bidder and so on.

• Every individual is allowed to bid for more than one costume and is therefore eligible for owning more than one costume

• After the highest bidder is selected for all costumes, he/she will be informed about the procedure to make the payment. However, the payment for the same will have to be made within a time period mentioned in the intimation letter

• Highest bidder shall be announced within a period of one month of the closure of bidding process.
• The bidding process is open only for Indian nationals residing in India

Other Terms and Conditions

1. Introduction and process
Zee Entertainment Enterprises Limited (the Company) is conducting SMS based auction of costumes used by various Bollywood actors/actresses in the films Some portion of proceeds of such auction shall be donated to the charitable trust (not decided as yet) Individuals can bid for costumes placed for auction which shall be subject to Process and Terms of Use as mentioned herein below.

1. Terms of Use and subsequent amendments:

1. • You may visit the Site to get yourself acquainted and familiarize with the SMS auctions process. However, being allowed to access the site, you bind yourself into these 'Terms of Use' that contains terms and conditions as set out hereinafter. The Company can from time to time revise these Terms of Use by updating this page. By using this Site, you agree to bind yourself with any such revisions and should therefore periodically visit this page to determine the then current Terms of Use to which you are bound. If you do not accept the terms and conditions let down in this user Agreement, please do not use this website and bid for any product.

 

1. • All amended terms shall automatically became effective immediately after they are posted on the site and any subsequent use of the site shall be governed by such amended terms.

1. • The Company may terminate, change, suspend or discontinue any aspect of the site, including the availability of the features, at any time. The Company may impose limits on certain features and services or restrict your access to any or all of the parts of this site without notice or liability.

b. Force Majeure
The Site shall not be responsible or shall take no liability to you for any interruption or delay in access to the site irrespective of the causes.

c. General
I. Applicable Laws
This site is controlled, operated and administered by Zee Entertainment Enterprises limited, having their registered office at Continental Building, 135, Dr. Annie Besant Road, Mumbai 400 018. This Agreement shall be governed by Indian laws. Disputes if any, arising out of these Terms of Use shall be resolved within the jurisdiction of Mumbai Courts only.

Although this site may be accessed from any state, as well as from other countries, by accessing this site you agree to abide by the statutes and laws of India, without giving effect to any principles of conflicts of laws relating to the use of this site.

II. Other
These terms constitutes the entire Agreement between you and the Company governing your use of the site. Should any provision in these terms be found invalid or unenforceable for any reason, then that provision shall be deemed to be severable from the terms and shall not affect the validity or enforceability of the remaining provisions. You agree that any claim arising out of or related to the terms or your use of the site must be filled within one month after it arose.

d. Specific

• This Auction is designed to function exclusively as an information intermediary between buyers and sellers of goods (Company and the producers of films where the costumes have been used).The costumes have been assigned to the company by the producers and the Company makes no warranty, express or implied, for any of the listed costumes merchantability and /or fitness and / or quality for a particular purpose.

• All specifications and descriptions quoted herein are on AS IS BASIS and the Company accepts no responsibility for any errors or omissions. All the Costumes offered herein is subject to withdrawal by the Company.

III. The Company is the sole and only deciding authority regarding determination of winning bidder. The Company’s decision as regards the highest/ successful bidders shall be final and binding. No Complaints regarding the same shall be entertained.

III. In the event of any dispute arising out the bidding process or Terms of Use or any other reason therefor, the Company shall be the sole deciding Authority, and its decision shall be binding on all the parties.

IV. The Company reserves the right to postpone or cancel an auction, or cease providing auction facility, without notice, should it, in its sole discretion, determine that such action is warranted.

V. The Company shall not have any liability or obligation towards the intended bidders as a result of any postponement, cancellation, or withdrawal by the Company.

e. The Company is not responsible for failure to execute a bid, for errors relating to the execution of a bid, or for technical problem, which may hinder the efficiency of a bid. The Company shall not be responsible for e-mail transmission time or delays. On all issues relevant to technical parameters, the technical determinations of the Company’s servers shall prevail over all others.

I. In no event shall the Company be liable for indirect, consequential, or incidental damages, or damages for lost profits, loss of revenues, or loss of use, arising out of or related to the this auction or the information contained in it, whether such damages arise in negligence or otherwise.

II. the Company shall have no liability to you for any interruption or delay in access to the site irrespective of the cause.

III. All bids are non-cancelable once submitted.

IV. the Company reserves the right to remove from the auction all/ any items from the bid.

V. The Company is not responsible for bids not being processed or not being accepted due to technical difficulties.

VI. Each auction is conducted independently, and the sale formats, terms & conditions of the sale and minimum bid amount may change from auction to auction.

VII. You cannot bid in a false name/phone number and shall be unlawful if so done. Even if such bid is initially accepted, the same shall be subject tot scrutiny to verify your details from your phone number. Please do not "test" our auction with false bids. Fraudulent bidders will be prosecuted to the fullest extent of the law.

VIII. Waiver and limitations of liability:
The Company, its employees or agents, shall not in any event be liable for any direct, indirect, incidental, special, consequential or exemplary damages arising out of, resulting from, or related to:

• Any use or any inability to use the services
• Cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or message received or transactions entered into through or from the services.
• Unauthorized access to or alteration of your transmission or data.
• The costumes, fabric used, fittings etc

f.) Disclaimer and warranties

• • Each user understands and agrees that any material and / or data downloaded from the Site or Costumes obtained through the services is done at user's own risk and that user will be solely responsible for any damages resulting from any downloading or other transaction.
  • No advice or information, whether oral or written, obtained by you from the Company or from the services shall create any warranty not expressly stated herein.

iii. General compliance with laws
You should be in compliance with all applicable laws, status, ordinance and regulations concerning your participation in, or use of, the services in any capacity, including but not limited to bidding or purchasing items.

• • Taxes

• You shall be responsible for paying all applicable taxes (including, but not limited to, sales tax, excise duty, custom duty, octroi etc). All other customers are responsible for directly submitting any sales tax required by the laws of their state of residence to the appropriate taxing authority

g.) No resale or unauthorized commercial use

This Agreement, including all your rights and obligations hereunder, shall not be assignable by you without the prior written consent of the Company. You also agree not to make any unauthorized commercial use of the Site.

h.) No Agency
You agree that neither this Agreement nor your use of the services creates any agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship between the Company and any user of the services.

i.) Notice
Any notice to you shall be made in writing at the address provided by you to the Company.

2. User Conduct
Bidding members:

• Must be at least 18 years of age.
• Shall not misrepresent their identities.
• Must always provide valid and complete contact information and must always have a valid email address.
• Cannot publish the contact information of other members in an online public area.
